CUSTOMER’S AGREEMENT ON ATELIER RICKY HONG (“Atelier”) PURCHASING POLICY AND CONDITIONS

Important: By placing an order with Atelier, you agree that your purchase is subject to the following terms and conditions. These Terms of Sale are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region (“HKSAR”). Nothing in these terms limits any non-excludable rights you may have under applicable HKSAR law.

No Refunds and Cancellations

  • Please ensure you wish to proceed before making payment.

  • Once you finalize and pay for your order (including pre-orders), you acknowledge and agree that the order is final and cannot be cancelled, and that no refunds will be provided, except as required by applicable HKSAR law or as otherwise expressly provided in these terms (for example, under the Warranty section or where a refund is offered at Atelier’s discretion).

  • This clause does not exclude or limit remedies available under HKSAR law for defective goods.

Payment, Errors, and Security

  • Payment may be subject to your card issuer’s security protocols (e.g., international purchase permissions, OTP verification, address validation).

  • If a payment error occurs, please verify your card’s international usage settings and security measures, or use an alternative payment method.

  • Atelier reserves the right to reject or cancel any order in the event of suspected fraud, pricing or listing error, or payment failure. If payment has been taken for a cancelled order, Atelier will process a refund of the amounts received for the cancelled order.

Pricing, Taxes, and Duties

  • Prices are shown exclusive of VAT/GST or similar taxes depending on your destination at checkout. Any applicable VAT/GST/excise taxes/tariffs/import duties for your jurisdiction may be estimated and collected at checkout where feasible, or otherwise may be payable by you upon import as required by local authorities.

  • You are responsible for any additional taxes, duties, fees, or charges imposed by customs or authorities in the destination country if not collected at checkout.

Shipping and Delivery

  • International shipments are dispatched via DHL, FedEx, or comparable reputable couriers from the origin point.

  • Shipping, handling, risk of loss, and delivery timelines are subject to the courier’s terms and conditions and operational constraints, as well as customs clearance in the destination country.

  • Title and risk of loss pass to you upon delivery to the courier unless otherwise required by applicable law. Atelier will assist in reasonable tracking and courier claims but is not liable for delays beyond its reasonable control.

  • Please consult the courier terms applicable to your country for details on delivery, customs processing, and any requirements.

Prevention of Resale and Purchase Limits

  • Atelier may limit, refuse, or cancel orders and suspend or restrict accounts suspected of commercial reselling or engaging in unauthorized resale activity. This may include limiting quantities or prohibiting future purchases.

  • Such measures are intended to preserve fairness for individual customers and protect brand integrity.

Warranty

  • Inspection: All items are inspected by watchmakers before dispatch to your designated address.

  • Warranty Period: Atelier warrants the watch against manufacturing defects for one (1) year from the date of purchase (“Warranty Period”) in accordance with these terms and applicable HKSAR law.

  • Claim Process: To make a claim within the Warranty Period, you must provide:

    • Clear evidence of the defect (e.g., photos and/or videos of the watch and its original packaging prior to return),

    • A photo of your warranty card, and

    • Proof of purchase (order confirmation or invoice).
      Atelier may provide return instructions. Do not return products without prior authorization.

    • Buyer is responsible for the shipping cost of return products.

  • Assessment and Remedy: Upon receipt and inspection of the returned item, Atelier will determine eligibility. If approved and subject to availability, Atelier may provide:

    • Repair or replacement of affected parts

  • Repair Time: Repair timelines vary depending on the condition and parts availability. If you are concerned about waiting times, please consider this before sending your watch for repair.

  • Exclusions: The warranty does not cover:

    • Theft, loss, acts of God or force majeure,

    • Accidents (including impacts, shocks, crushing), natural disasters,

    • Damage due to mishandling, improper use, misuse, or neglect,

    • Tampering, modification, or servicing by any party other than an Atelier-authorized service center or dealer,

    • Normal wear and tear and aging (including cosmetic changes),

    • Straps, boxes, and accessories.

  • Misuse: Atelier is not responsible for damage arising from misuse, including excessive shocks or vibrations, exposure to strong electromagnets, or similar activities that may affect functions or cause damage.

Consumer Rights and Defective Goods

  • Nothing in these terms excludes or limits rights you may have under applicable HKSAR law in relation to defective goods. If goods are defective under applicable law, you may be entitled to repair, replacement, or other remedies. Please contact Atelier promptly with details and evidence of the defect.

Returns Authorization and Condition

  • Any return must be pre-authorized by Atelier. Items returned without authorization may be refused.

  • Returned items must include all original items supplied (e.g., warranty card, packaging, accessories) unless otherwise instructed, and must be securely packaged. You are responsible for loss or damage in transit where applicable law allows; consider using tracked and insured shipping as instructed by Atelier.

Limitation of Liability

  • To the maximum extent permitted by HKSAR law, Atelier’s total aggregate liability arising out of or relating to any product or these terms shall not exceed the price you paid for the product giving rise to the claim.

  • Atelier will not be liable for any indirect, consequential, incidental, special, punitive, or exemplary damages, loss of profits, or loss of data, except where such limitation is prohibited by applicable law.

Force Majeure

  • Atelier will not be liable for any delay or failure to perform due to events beyond its reasonable control, including but not limited to acts of God, natural disasters, epidemic or pandemic, war, terrorism, labor disputes, governmental action, supply chain disruption, or courier/customs delays.

 

Accuracy, Availability, and Errors

  • Atelier endeavors to ensure product descriptions, availability, and pricing are accurate but does not warrant that they are error-free. Atelier may correct errors, update information, or cancel orders if any information is inaccurate, with a refund where payment has been received.

 

Personal Data and Privacy

  • Your personal data will be collected, used, stored, and disclosed in accordance with Atelier’s Privacy Policy and the Personal Data (Privacy) Ordinance (Cap. 486) of HKSAR, as applicable.

 

Compliance with Import and Use Laws

  • You are responsible for ensuring that the import, possession, and use of the product complies with the laws and regulations of the destination jurisdiction.

 

Governing Law and Dispute Resolution

  • These terms and any dispute arising out of or in connection with your purchase are governed by the laws of HKSAR.

  • The parties submit to the exclusive jurisdiction of the courts of HKSAR. Atelier may also agree to alternative dispute resolution (e.g., mediation) where appropriate.

 

Changes to Terms

  • Atelier may update these Terms of Sale from time to time. The version in force at the time of your order will apply to that order unless changes are required by law.
